1. No promises or representations made outside of this agreement will be honored.

2. The Reference Store is NOT an employment agency or employee recruiting firm; and makes no representations or guarantees whatsoever regarding the effectiveness or timeliness of services provided in meeting the employment, tenancy, romantic, or the otherwise personal objectives of the user.

3. If the management of The Reference Store observes any criminally suspicious activities, these activities will be immediately reported to the proper authorities.

4. The Reference Store uses ONLY that information provided by the user. The user agrees to hold the company, its employees, its officers, and its Shareholders harmless for any omissions made by the user. The user agrees that the company will NOT “Fill in the blanks”.

5. The user assumes full responsibility for all information submitted to The Reference Store.

6. Full acceptance of this contract by the user is required to obtain and maintain service with The Reference Store. The Reference Stores’ services may only be used for lawful purposes.

7. The Reference Store provides services to adult users engaged in legal activities only.

8. The services of The Reference Store cannot be used for any illegal purpose whatsoever.

9. If it is discovered that a user is using the services of The Reference Store for an illegal purpose, that user will be denied further access to the company's services.

10. The Reference Store carries out its services using only the information received from the user. Any reliance upon any services shall be at user's sole risk.

11. The Reference Store reserves the right, in its sole discretion and without any obligation, to change any portion of any service in order to make improvements or correct any errors or omissions.

12. The Reference Store will not be held liable for the quality or continuity of the service, nor for any losses or circumstances arising from lack of service continuity.

13. No liability can be accepted for the accuracy of the analysis, or the use, or misuse, of the information provided.

14. Fully purchased service requests will be processed as soon as possible. This will normally be within one (1) to ten (10) working days of receipt. However, this time period varies depending on complexity of the users circumstances and/or circumstances beyond our ability to control.

15. The down payment portion of service Offers purchased using the “Layaway” payment option, shall be not be refunded.

16.Under no circumstance shall setup fees be refunded.

17. Purchased, executed orders shall not be refunded.

18. Purchased orders that weren't executed are eligible for a full or partial refund within 30 calendar days of the payment and eligible for a site credit within 31 to 90 calendar days of the payment.

19. You agree not to use our services to propagate any unlawful, threatening, abusive, libelous, defamatory, obscene, offensive, indecent, pornographic, profane, or otherwise objectionable information of any kind, including without limitation any endorsement constituting or encouraging conduct that would constitute a criminal offense, give rise to civil liability, or otherwise violate any local, state, federal or international law, including without limitation the U.S. export control laws and regulations, and laws protecting intellectual property including copyright, trademark, trade secret, misappropriation and anti-dilution laws.

20. You agree to indemnify, defend, and hold harmless The Reference Store and all of its employees, Officers, and Shareholders from any and all legal action, liability, penalties, losses, damages, costs, expenses, attorneys' fees, causes of action or claims caused by or resulting indirectly from your use of our service(s) which damages either you, The Reference Store , or any other party or parties without limitation or exception. This indemnification and hold harmless agreement extends to all issues associated with your account or requested services.

21. The Reference Store makes no warranties or representations of any kind for the services being offered, including warranties of merchantability or fitness for any purpose.

22. You agree not to hold The Reference Store or its employees responsible for any loss you suffer as a result of using our services, including but not limited to loss resulting from service delays and incomplete or interrupted service, regardless of cause.

23. The Reference Store reserves the right to cancel your account or service for any reason and at any time.

24. You agree that the terms and conditions of this contract extend to any party you give access to your account(s) and you are ultimately responsible for the results and actions of such parties.

25. You agree to supply a current and truthful name, postal address, and telephone number for our records. You also confirm that you are an authorized user of
any credit card that you supply to us, and that you are 18 years of age or older.

26. You agree that yearly setup fees are non-refundable after the time of account or service activation.

27. This contract supersedes any and all written, electronic, or oral communication you may have had with The Reference Store or any representative thereof.

28. Violation of any of the terms and conditions of this contract may result in the immediate termination of your service(s) or account(s) with The Reference Store or any of its divisions or resources, at our discretion. Criminal or civil prosecution may result in extreme cases.

29. User agrees to be the sole individual responsible for funding fees on an ON TIME BASIS. Time is of the essence; and that one (1) minute late is too late. The user has the duty to keep a calendar of the appropriate dates. In the event of a LATE PAYMENT, the user is responsible to submit a LATE FEE of $29,95 (USD) in addition to all applicable SERVICE FEES.

30. You agree that any and all disputes shall be decided by mediation in the City of San Diego, San Diego; County, California, in the United States of America.

31. A refund may be granted when an interview is not offered to the user and the lack of such an offer can be verified by The Reference Store. The user agrees to allow The Reference Store to investigate any and all claims for refund for a period of up to 29 days.

32. User agrees that no refunds will be given in the event of service cancellation for any of the above mentioned causes.

33. User agrees that all Reference Contacts received on behalf of the user, will be reported to the user not later then thirty-six (36) hours of receipt and shall contain only incoming phone call information.

34. User agrees that The Reference Store, its officers, employees and managers, have the right to fully cooperate in any and all legal investigations regarding any aspect of our services, including services sold to you.

35. User agrees that any and all phone conversations to and, or from The Reference Store, may be recorded for quality assurance and, or training purposes.

36. The user understands that, he or she has made a knowing decision to buy a service; AND THERE IS NO COOLING OFF PERIOD.

37. The user agrees that sole ownership and control of internet Domain Names, Web-sites and phone numbers, developed to serve the users interests, shall rest with and is the sole property of The Reference Store; and these Internet Domain Names, web-sites and phone numbers may be changed, altered, suspended or cancelled at anytime at the sole discretion of The Reference Store.

ALL SERVICES ARE PROVIDED BY THE REFERENCE STORE, ON AN «AS IS» BASIS, AND THE REFERENCE STORE EXPRESSLY DISCLAIMS ANY AND ALL WARRANTIES, EXPRESSED OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE, WITH RESPECT TO THE SERVICE OR ANY MATERIALS AND PRODUCTS. IN NO EVENT SHALL THE REFERENCE STORE BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES OF ANY KIND WHATSOEVER WITH RESPECT TO THE SERVICE, THE MATERIALS AND THE PRODUCTS.
YOU AGREE TO ASSUME ALL RESPONSIBILITY AND RISK FOR YOUR USE OF THE SITE, THE INTERNET GENERALLY, AND THE DOCUMENTS YOU POST OR ACCESS AND FOR YOUR CONDUCT ON AND OFF THE SITE.

(b) IN NO EVENT SHALL THE REFERENCE STORE inc;(OR ANY OF ITS OFFICERS, DIRECTORS, SHAREHOLDERS, EMPLOYEES, AFFILIATES, AGENTS OR ADVERTISERS), BE LIABLE FOR ANY DIRECT OR NON-DIRECT DAMAGES WHATSOEVER (INCLUDING, WITHOUT LIMITATION, INCIDENTAL AND CONSEQUENTIAL DAMAGES, LOST PROFITS, OR DAMAGES RESULTING FROM LOST DATA, LOST EMPLOYMENT OPPORTUNITY, OR BUSINESS INTERRUPTION) RESULTING FROM OR ARISING UNDER OR IN CONNECTION WITH THE USE OR ACCESS TO, OR THE INABILITY TO USE OR ACCESS, THE SITE AND/OR ANY DOCUMENT, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT THE REFERENCE STORE IS ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
