1. Reservation Deposit. A deposit of 20% is due to hold the date. The balance is due on the date services are to be provided. The Reservation Deposit is non-refundable if the event date is changed or canceled for any reason.
2. Coverage Schedule. Coverage will start and end at the agreed upon scheduled times unless other arrangements are made and agreed to by TI and the Client.
3. Copyrights. The photographs and/or video produced by TI will remain the property of TI until such time that it is delivered to client. Upon delivery to client, TI releases copy rights to Client.
4. Promotional Use. Client agrees that TI may make use of a couple of photographs and/or a sampling of video clips to promote its business.
5. Delivery Schedule. TI will provide its best efforts to deliver the final product within the time estimated. Unless otherwise stated, the estimated time is 7 to 10 days.
6. Coverage. TI will take the number of photographs or video clips that it deems necessary to capture the event and to fulfill its obligations under the arrangements made with Client.
7. Editing TI may make enhancements to photographs and/or video footage as it deems necessary to produce a quality product. Any additional editing that may be requested by Client is not included in the original price and will be billed at TI's hourly rates.
8. Limit of Liability. TI will make every effort to provide services to client on the scheduled date; however, in the unlikely event of a medical emergency, accident, natural or other disaster that would prevent TI from performing services, then all payments including the Reservation Deposit will be returned to Client. TI takes great care in handling and maintaining its equipment, including having backup equipment available; however, in the unlikely event that digital photos or video become damaged, lost, stolen or destroyed for reasons beyond TI's control, TI's liability will be limited to the return of all payments received. TI promises to provide its best efforts, but makes no guarantees on the outcome of photos or videos and Client's sole remedy will be the return of fees paid to TI for the services.
9. Governing Law. This agreement shall be governed by the laws of the State of Delaware, and any claim that may be brought against TI must be brought within the jurisdiction of the State of Delaware.
10. Acceptance of Terms. By entering into a service agreement with TI, Client accepts and agrees to the Terms of Service provided herein. A service agreement consists of Client's acceptance of a proposal for services from TI (this may be via email or phone call) and payment of the Reservation Deposit.
