Property Rights

I/We understand that Lab Rescue OK, Inc. retains all property rights over the dog(s) in foster home. Lab Rescue OK Inc, it's members and representatives may retake posession of the dog(s) from the Foster(s) at any time for any reason; including but not limited to if any of the conditions of this agreement are violated in any way or it is found that the dog is being abused, neglected or mistreated.

Period of Fostering

I/We agree to foster the dog until a suitable permanent home can be found or until Lab Rescue OK. Inc. can make alternative foster arrangements. Foster understands that Lab Rescue OK, Inc. has high standards for permanent homes and that the fostering period could range from a few days to several months or more. Lab Rescue OK, Inc. agrees to make a good-faith effort to find a suitable match as quickly as possible.

Training Tools

I/We understand that where behavior/training recommendations are concerned; I/We promise to notify Lab Rescue OK, Inc. if additional training is needed for the dog(s) and I/We promise not to use training tools such as electronic collars, unless the use of them has been approved by a Lab Rescue OK Representative or a behaviorist/trainer that is approved by Lab Rescue OK, Inc?

Adequate Shelter/Off Leash/Tethering

Foster(s) agrees to provide a safe living environment for the dog(s). This includes but is not limited to: 1) appropriately crating the dog inside the home when you are away 2) providing adequate shelter, water, shade, dog to dog safety and a secure fenced area outside during the day, only in good weather. All foster dogs must be kept inside the home at night.

When Off of my Property, the dog(s) will be kept on leash unless it is in a fenced area approved for loose dogs, ie: dog park.

I/We promise to never leave the dog(s) tethered/leashed on tie out unless under the direct supervision of a responsible adult.

Regular Updates

I/We agree to provide photos of the dog and a regular status report via e-mail correspondence to other@labrescue.net and by filling out the Bio/Information form provided via electronically by Lab Rescue OK, Inc. Such status reports will aid significantly in the placement of the dog into a permanent home by Lab Rescue OK, Inc's other volunteers. Basic information about the dog’s health and personality should be provided. However, Foster agrees to contact Lab Rescue OK, Inc. immediately in the event of any medical emergency, loss or theft of the dog, or any signs of aggression (growl, snap, snarl, or bite) toward any human or other animal. I/We will e-mail other@labrescue.net/or contact a Lab Rescue OK, Inc. representative by telephone.

Contact with Potential Adopters

I/We agree that upon approval of an application for adoption by Lab Rescue OK, Inc. I/We will discuss the dog with any approved applicant, make arrangements to do meet n greets with Potiential adopters and/or bring the dog(s) to Adoption Events as often as possible. Foster is required to assist Lab Rescue OK, Inc. in finding a good match.

NOTE: ALL PEOPLE AND ALL ANIMALS LIVING IN THE ADOPTIVE HOME MUST MEET THE DOG BEFORE THE ADOPTION CAN OCCUR.

I/We understand that the dog(s) can only be released to the adopter only as notified by an authorized Lab Rescue OK, Inc. member/representative and only upon payment and receipt of the Adoption Agreement.

Actions, Disposition/Temperament

I/We understand that every effort has been made to assess the disposition/temperament of the dogs released to Lab Rescue OK, Inc. beforehand, but being living animals, they may act Unpredictably in any given situation and that as I am the caretaker of the dog(s); I/we must take the necessary precautions for the safety of the dog(s), Foster(s), Family Members and any other human being or any other animals to prevent accidents and guard against unpredicted actions by this dog.

Training

I/We understand that the dog(s) may not be housetrained or even accustomed to living indoors. I/We promise to make a good faith effort to assist with housetraining and leash training of the dog(s). I/We will not allow the foster dog on any furniture.

Health and Welfare

I/We Promise to provide adequate care of the dog(s) while in my/our possession. I promise to give food, water, shelter and otherwise care for the dog(s), monitor the health of the dog(s), including transporting to an approved veterinarian when necessary and to administer any necessary veterinary medicines. I promise to administer the monthly heartworm and flea/tick preventative provided to me/us by Lab Rescue OK, Inc. I/We promise to notify Lab Rescue OK, Inc, it's members and representatives if the dog(s) is/are in need of any veterinary care; including but not limited to vaccinations, testing, illness, injury, medicines or monthly preventatives in a timely manner.

Veterinary Care

Lab Rescue OK Inc. agrees to provide the dog all necessary veterinary care through it's approved veterinarians at it's sole expense after approval. I/We agree to contact Lab Rescue OK, Inc. for approval PRIOR to obtaining any veterinary care for the dog. Lab Rescue OK, Inc. has the right to deny reimbursement for unapproved veterinarian expenses. All fosters should ensure that their personal dogs are up-to-date with their current vaccinations and all resident animals are spayed and/or neutered. We HIGHLY recommend that all dogs receive a bordatella vaccination to protect against kennel cough, which is a common illness with shelter dogs. Lab Rescue OK, Inc. is not responsible for any veterinary bills for resident pets.

Emergency Medical Care

Should an emergency arise, Foster agrees to obtain medical care for the dog after contacting a Lab Rescue OK, Inc. representative for approval. Lab Rescue OK, Inc. shall reimburse the Foster for justified emergent care that is pre-approved. Foster agrees to make good-faith effort to obtain such care from an approved veterinarian if possible. *

Adopting or Fostering to Adopt

I/We understand that Lab Rescue OK, Inc. retains all property rights over the dog(s) in foster home.

If I/We determine that we want to adopt our foster dog(s), we agree to notify Lab Rescue OK, Inc. as soon as that decision has been determined and that if a Potential Adopter has already been notified that your foster dog is available, then that Potential Adopter has first right of refusal regarding adopting the dog(s).

Indemnification

The Foster(s) will, and hereby does, indemnify and hold harmless Lab Rescue OK, Inc. against any losses, claims, damages or liabilities, joint or several, to which the Lab Rescue Ok, Inc. may become subject and arise out of or based upon any unlawful, negligent, intentional, or willful conduct of the Foster(s), its employees and agents or the performance of any and all activities associated with fostering the dog by the Foster(s), including but not limited to:
(a) Any breach, alleged breach, or failure of the Foster(s) to provide proper, reasonable, and adequate foster activities;
(b) The negligence or willful misconduct of the Foster(s) or its officers, directors, employees, agents, contractors, visitors, invitees, licensees, customers and or representative; and
(c) Any unpredictable conduct of the dog, including but not limited to biting, snapping, growling, or show of aggression towards another person or persons.

The Foster(s) will reimburse Lab Rescue OK, Inc. for any legal or any other expenses reasonably incurred in connection with investigating or defending any such loss, claim, liability, action or proceeding; provided, however, that Foster(s) shall not be liable to Lab Rescue OK, Inc. to the extent that any such loss, claim, damages, liability (or action or proceeding in respect thereof) or expense arises out of or is based upon any unlawful, negligent, intentional, or willful misconduct of Lab Rescue OK, Inc. Lab Rescue OK, Inc. will have the right to participate in such defense with counsel of its own choice, and the Foster(s) will provide reasonable assistance to Lab Rescue OK, Inc. and its counsel.

Waiver of Liability

I hereby assume all of the risks of participating in any and all fostering activities associated with fostering the dog including by way of example and not limitation, any risks that may arise from the unpredictable conduct and nature of the dog, negligence or carelessness on the part of the persons or entities being released, or because of their possible liability without fault.

I certify that I am physically fit, have sufficiently prepared or trained for fostering the dog and have not been advised to not foster the dog by anyone including but not limited to a qualified medical professional. I certify that there are no health-related reasons or problems which preclude my participation in fostering a dog.

I acknowledge that this Waiver and Release of Liability Form will be used by Lab Rescue OK, Inc., and that it will govern my actions and responsibilities related to any and all activities associated with fostering the dog.

In consideration of permitting me to foster the dog, I hereby take action for myself, my executors, administrators, heirs, next of kin, successors, and assigns as follows:

(A) I WAIVE, RELEASE, AND DISCHARGE from any and all liability, including but not limited to, the unpredictable conduct and nature of the dog, liability arising from the negligence or fault of the entities or persons released, for my death, disability, personal injury, property damage, property theft, or actions of any kind which may hereafter occur to me, THE FOLLOWING ENTITIES OR PERSONS: Lab Rescue OK, Inc. and/or their directors, officers, employees, volunteers, representatives, agents, and sponsors.

I acknowledge that Lab Rescue OK, Inc. and their directors, officers, volunteers, representatives, and agents are NOT responsible for the errors, omissions, acts, or failures to act of any party or entity conducting a specific activity on their behalf.

I acknowledge that this activity may involve physical activity, being around and in close contact with the dog which is of an unpredictable nature and carries with it the potential for death, serious injury, and property loss. The risks include, but are not limited to, those caused by the unpredictable actions of the dog, facilities, temperature, weather, equipment, vehicular traffic, and actions of other people including, but not limited to, volunteers, monitors, veterinarians, and/or sponsors of the activity. These risks are not only inherent to Foster(s), but are also present for family member(s) of Foster(s), neighbor(s) of Foster(s), and invitees of Foster(s).

The Waiver and Release of Liability Form shall be construed broadly to provide a release and waiver to the maximum extent permissible under the law of Oklahoma and federal law.

I CERTIFY THAT I HAVE READ THIS DOCUMENT AND I FULLY UNDERSTAND ITS CONTENT. I AM AWARE THAT THIS IS A RELEASE OF LIABILITY AND A CONTRACT AND I SIGN IT OF MY OWN FREE WILL.

I/WE, THE FOSTER(S) HAVE READ AND UNDERSTAND ALL THE TERMS AND CONDITIONS OF AGREEMENT AND AGREE TO ABIDE BY ALL THE TERMS AND CONDITIONS STATED HEREIN.

I/WE, THE FOSTERS(S) UNDERSTAND, ACKNOWLEDGE AND EXPRESSLY AGREE BY SUBMISSION OF MY/OUR ELECTRONIC SIGNATURE HEREIN BELOW TO BE EXPRESSLY BOUND BY ALL TERMS OF THIS AGREEMENT AND ACKNOWLEDGE THAT THIS AGREEMENT SHALL BE FULLY ENFORCEABLE AND BINDING AGAINST ME/US AS IF EXECUTED BY MY/OUR OWN HAND. *
