Failure to Perform:
If the photographer cannot perform this agreement due to fire or other casualty, strike, act of God or cause beyond the control of the parties, then the photographer shall return the deposit to the client. This shall also apply in the event photographic materials are damaged without fault on part of the photographer. In the event the photographer shall not be liable for any amount in excess of the retail value of the client order. Should the contracted photographer become sick or unable to perform with short notice of the event, Amy Lundstrom Photography will offer to supply an alternative photographer for the event.
Agreement to Arbitrate:
The client and Amy Lundstrom Photography agree to submit any dispute arising under this binding agreement in accordance with the Better Business Bureau. The arbitrator's decision will be final and binding on both parties. Neither party will be able to go to court for disputes that must be arbitrated.
Digital Image Files:
The images produced are high resolution JPG files.We provide these files to you on DVD's or USB Drive. We recommend that you transfer your images to a hard drive and work with the images from your hard drive and store the DVD's or USB Drive in a safe and dry area. Never give your DVD's to a lab, always make them a copy. (We can provide you with a copy set for $50) We will keep a master copy of your images on file for one year. One year after your wedding date you will become 100% responsible for your images and we may no longer have your images on file.
Albums & Ordering:
You may be able to view/order from your wedding/event approximately 5-6 weeks after the event date. Depending on the package you select; reprints, enlargements and albums included in your package must be ordered within twelve months of your wedding date. If you have not provided Amy Lundstrom Photography with the necessary information required to finish the album order, you will forfeit the money you paid toward those items as part of your package.
Cancellation Policy: If the client cancels this service within five weeks of the event date, the full amount of photography coverage package is due to the photographer. If the cancellation is in advance of five weeks from the event date then the deposit will be retained if the date is not re-booked but the package balance will not be due.
