By the undersigned participant (or the parent/guardian of a participant under the age of 18) (the “Participant”), in favor of Hoop Dynamics LLC, its owners, officers, employees, contractors, volunteers, and agents (collectively, “HoopDynamics”).
1. Acknowledgment of Risks
Participant acknowledges and agrees that participating in basketball training sessions, practices, and related activities involves inherent risks, including but not limited to:
• Physical injury (e.g., sprains, fractures, concussions).
• Physical exertion and overexertion.
• Equipment failure or improper use.
• Collisions with other participants, coaches, or objects.
• Facility conditions and environmental factors.
Participant voluntarily assumes all risks associated with participation in such activities.
2. Release of Liability
In consideration for being allowed to participate in HoopDynamics activities, Participant hereby agrees to release, waive, and discharge HoopDynamics from any and all claims, demands, actions, causes of action, or liability for injuries, damages, or losses arising out of or in connection with Participant’s participation in the activities, whether caused by the negligence of HoopDynamics or otherwise, to the fullest extent permitted by law.
3. Indemnification
Participant agrees to indemnify and hold harmless HoopDynamics from any claims, demands, actions, or damages, including reasonable attorneys’ fees and costs, arising out of Participant’s actions, negligence, or conduct during participation in HoopDynamics activities.
4. Medical Treatment Authorization
In the event of an injury or medical emergency, Participant consents to HoopDynamics providing or arranging for reasonable medical treatment. Participant understands and agrees that HoopDynamics assumes no responsibility for any medical expenses incurred.
5. Insurance
Participant acknowledges that HoopDynamics does not provide health or accident insurance and that Participant is responsible for obtaining and maintaining their own insurance coverage.
6. Photography and Media Release
Participant grants permission for HoopDynamics to use photographs, videos, and other media of Participant taken during training sessions for promotional and educational purposes, without compensation or further consent.
7. Parent/Guardian Consent (if applicable)
If the Participant is under the age of 18, the undersigned parent or legal guardian agrees to the terms of this Agreement on behalf of the minor participant and acknowledges the risks of participation.
8. Governing Law
This Agreement shall be governed by and construed in accordance with the laws of the state in which HoopDynamics operates. Any disputes shall be resolved in courts of competent jurisdiction in that state.
Acknowledgment and Agreement
By signing below, Participant acknowledges that they have read, understood, and agree to the terms of this Agreement. Participant further affirms that they are physically fit to participate in the activities provided by HoopDynamics.
