Service Order Contract
Terms of Service, Privacy, Cookies, and GDPR
LOGISTICS:
• Hours of operation: By appointment ONLY.
• CLOSED ON MONDAY
• CLOSED ON ALL MAJOR HOLIDAYS.
ORDERING:
• Order and payment communications are sent via email, please check your email frequently and respond in a timely manner. Invoices not paid by the due date will be canceled.
• Order menu is CUSTOM CAKES AND CUPCAKES ONLY! We do not offer items that are not listed on the order form.
• Please allow up to 48 hours response time when inquiring/ placing an order.
• Order Inquiries/ Quote Requests can be submitted via the designated inquiry/ quote form.
• Orders must be placed a minimum of 3 or more weeks in advance. It's strongly suggested to order ahead of time to ensure the date requested is available. Be prepared to submit your payment when you place your order. Invoices are sent via PayPal.
• Prices are subject to change without notice.
RUSH ORDERS:
• Orders placed between 5-14 days before the due date will be charged a rush fee. The rush fee is 25% of the order total.
• All RUSH orders are based upon open availability and are not guaranteed.
PAYMENT:
• 100% Upfront non-refundable payment is due for orders up to $300. A non-refundable, 50% RETAINER FEE is due for orders over $300, with the balance due 14 days prior to the pick up date. You will recieve a PayPal invoice to review and pay. Invoices are to be paid within 24 hours. Unpaid invoices will be canceled.
* Why an Upfront Payment & Retainer Fee is Necessary:
1. Customization: Custom cakes are difficult to resell if the customer fails to pick them up.
2. Time and Materials: It covers the cost of special materials and protects the baker’s time, which is considered money.
3. Schedule Security: It locks in the order and ensures the client is committed.
4. Retainer goes towards the total cost.

• Payments processed through PayPal have a 5% service fee.
• Sales tax: Illinois sales tax is applied to all orders except for tax exempt entities.
• Prices are non-negotiable. SCSS withdraws from offering discounts of any kind and prefer to maintain fixed prices that are firm and equal for all prospects.

REFUNDS, CANCELLATION & CREDIT:
• Due to offering customized services, which are made-to-order as well as items that are not in-stock and readily available all orders are deemed non-refundable. we can only take so many orders per month. With that being said, no refunds are given.
• If an order is cancelled, the payment made on your order is non-refundable. Notification of cancellation must be made via email 10 or more days prior to the pick up date. We will be happy to transfer any payment made on the order to another order within 30 days from that date of cancellation. A 10% cancellation fee will be withheld from your total credit amount. Credits will not be issued for cancellations made with less than 10 days notice (no exceptions).
SERVING SIZE:
• Servings per cake is an estimation and not guaranteed to be exact.
PICK UP/ DELIVERY:
• CURBSIDE PICK.... Orders must be picked up on the agreed-upon date and time. Due to scheduling and storage limitations, we may not be able to accommodate late pickups. If any changes arise, please notify us as soon as possible via phone to avoid forfeiture of your order.
• DELIVERY... when available, cost varies and are dependent upon the delivery location.
INTELLECTUAL PROPERTY:
• Suga Coated Sweet Shoppe does not replicate or copy the work of other bakers or businesses. Inspiration photos are welcome and may be used as a reference; however, designs may vary slightly while still remaining as close as possible to the inspiration provided.
• Requested designs that are exact replications of copyrighted material are not accepted.
• All of our delectables are photographed and shared on our website as well as our social media platforms.
LIABILITY:
• Suga Coated Sweet Shoppe is not liable for damage to a cake not caused by Suga Coated Sweet Shoppe, property damage, guest injury, harm caused by eating non edible accessories, post pick up damage, or allergic reactions.
DO NOT SMASH FACES AGAINST A CAKE! Most of our products have support dowels inside that could cause harm.
• IMPORTANT FOOD ALLERGY INFO: Each of our products are made with the freshest ingredients available to us. We cannot guarantee that all products have not come in contact with any allergens. All items are prepared in the same kitchen. If you have an allergy to nuts or any other ingredient we do not recommend consuming our
products. If you have an allergy it is your responsibility to notify us of that issue prior to placing an order.
• Information obtained from Suga Coated Sweet Shoppe, LLC. is not shared in public. Any data transmission is through secured SSL. We utilize integration with trusted payment gateways such as PayPal, Zelle, and Square. These features enable SCSS to securely process payments, verify and authorize credit cards, and ensure a seamless and reliable experience for our customers. Privacy of information extends for both active and non-active users of our services. Data is kept confidential until stated by the law. The utilization of information is strictly for operational purposes only. Credit card information is not stored within our system. All services are protected by strong passwords, MFA, and other security settings. We do not share your information or data with third parties except in the following limited circumstances: Facilitate customers in making credit card payments via integrated gateways.
