This is a binding agreement between LOFT 402 (Jessup Deane Creatives/LOFT 402) herein LOFT 402 and below signed Renter dated:

Upon signing, Renter agrees to the Following terms:
This agreement confirms the rental of LOFT 402 for the day(s) and rate specified and obligates the undersigned to pay the amount of the rental noted below, including any additional unforeseen expenses incurred during the dates of the rental. Unforeseen expenses might include, but are n ot limited to; additional rental days, overtime, equipment rental, damages, clean - up fees, waiting time for sets, props, equipment, etc.
WAIVER OF LIABILITY
LOFT 402 rents its facility, including equipment, to its customers with the understanding that in no event shall LOFT 402 be held liable for direct, indirect, incidental, or consequential damage, mishaps, accidents, or loss due to the use of this facility or equipment used by its customers.

hereby waives and holds Harmless Jessup Deane Creatives/LOFT 402, its owners, agents, employees, affiliated independent contractors and management from any incident or accident which may occur to or by persons either renting or associated with the renting of LOFT 402 on the dates noted below, or any additional dates added later. Renter agrees to waive the right to seek legal redress for mishaps, accidents, and loss while on our premises. Renter assumes full responsibility for loss and/or damage to any property or equipment whether belonging to LOFT 402, crew members, talent or others from whatever cause during this agreement. LOFT 402 is not responsible for articles left behind by Renter. LOFT 402 will not be held liable for missing packages. All packages and/or deliveries sent to your production through a 3rd party (Fed-Ex, UPS, etc.) will be checked in with the front desk and sent to our mailroom. We will not deliver packages to you. All packages must be retrieved and signed out by client. All packages left behind by client for 3rd party pickup, must be signed into our mailroom system with the studio managers. Renter shall cover Loss of Income equal to the base rental rate of lost/damaged property or equipment multiplied by the number of days required to repair or replace lost/damaged item. All equipment is offered for inspection. Failure to inspect waives Renter's rights to claim facilities and equipment were not in conformity with those requested and in good state of repair at time of delivery. Renter also agrees to have read, fully understand and agree to be bound by the general rules and payment terms of LOFT 402.

INSURANCES
Please contact your insurance agent to obtain a certificate of liability insurance (COI). Include Jessup Deane Creatives/LOFT 402 ( 63 N3RD ST #402 BROOKLYN NY 11249 as additionally insured and loss payee under renter’s comprehensive general liability policies. Comprehensive general liability must be in an amount not less than: $1,000,000/1,000,000 Bodily Injury Liability and $1,000,000 Property Damage Liability. The Renter shall provide proof of said insurance 72 hours prior to its use of the premises. Please email certificate to: INFO@LOFT402.COM
RENTAL PERIOD, FEES, CLEANUP
Each rental is a 8-hour day or a 4-hour half day from load in to load out. Prep days and Strike days must be scheduled. There is a 15 min grace period for overtime after which overtime fees will accrue hourly at $100 per hour, after 10pm at $150/hour. A power surcharge will be added for film, video or other excess power usage or excessive crew size of $150. A cleaning fee of $100 will apply if the studio is not returned to the state in which it was delivered.
CANCELLATION POLICY
By signing this Rental Agreement and booking LOFT 402, Renter agrees to pay the daily rate for each day booked regardless of cancellation. Whenever possible, LOFT 402 will rent the facility in question to another client and waive the fee for original Renter. You have 48hrs prior to your rental to cancel at no charge. A a 50% fee will be charged for cancelations within 48hs of the beginning of your rental.
PAYMENT TERMS
All payments are due in full at the conclusion of shoot/day by check, cash, or credit card only, unless other terms have been established . LOFT 402 shall have no obligation to hold the studio space for the rental period designated below unless the Renter provides it with a non-refundable deposit of 50% of the rental fee. Interest will accrue on all accounts in default for more than 20 days. Renter must have current credit card authorization form on file. LOFT 402 has the right to charge all amounts that are past due to renter’s credit card. Renter authorizes LOFT 402 to charge the Renters credit card on file for the rental fee and for any overtime or clean up fees. Please make all checks payable to: LOFT 402.
