Upon booking with Lisa Gerken Photography, the session fee of $100 is due in FULL to book your session.

The session fee will go towards the price of of your package. It can be mailed to 26518 west 322nd street Paola Ks 66071. If client decides that they are no longer in need of photographer's services, this retainer fee is NON refundable. Client is allowed to switch dates 2 times within a month's time if photographer has the date available. After the second move, if client cancels again, no monies will be refunded.

On the day of session, the remaining package fee is due in full.

Any returned/bounced checks will require immediate $35 charge.

The session fee reserves discussed date and covers the time of photographer during the session. There is limited space per month and cancellations prevent photographer from booking with paying customers therefore no refunds are given unless there is an unexpected miscarriage or stillborn birth. God forbid any of my families face this.

Please allow 4 weeks for turn around. During busy season 6 weeks may be needed. After post processing has been finished, photographer will deliver temporary digital gallery. Client will have 1 month to download all images before gallery expires. Once gallery expires, it will cost $35 to regain access. After 1 year all galleries are removed and photographer is NOT responsible for any lost images.

Photographic Materials. All photographic materials, including but not limited to negatives, transparencies, proofs, and previews, shall be the exclusive property of the Photographer. The Photographer shall make gallery preview/downloads available for a period of 1 month. downloads must be made during this time. All session files, including digital negatives, will be destroyed after one year. Lisa Gerken Photography is NOT responsible for the lifespan of any photo after they have been successfully delivered to the client. When digital links are emailed, those links expire after 1 month and it is client’s responsibility to transfer digital files to USB or flash drive before that link is expired. After one month to regain access to gallery, it is a $35 fee. Photographer is not responsible for lost photos if client fails to meet this requirement. PLEASE save photos immediately to a safe source of keeping.

Copyright and Reproductions. The Photographer owns the copyright to all images created and shall have the exclusive right to make reproductions. The Photographer can make reproductions for the client or for the Photographer’s portfolio, self-promotions, entry in photographic contests or art exhibitions, editorial use, web design use, or for display within or on the outside of the Photographer’s studio. If the Photographer desires to make other uses, the Photographer shall not do so without first obtaining the written permission of the Client.

Client’s Usage. The Client is obtaining prints for personal use only, and shall not sell said prints or authorize any reproductions thereof by parties other than the Photographer unless a signed Usage License is acquired from the Photographer. If any photos are entered into contests, newspapers, or magazines, Lisa Gerken Photography MUST be mentioned and given full credit for photos.

Failure to Perform. If the Photographer cannot perform to this Agreement due to a casualty, act of God, or other cause beyond the control of the parties, or due to the Photographer’s illness, then the Photographer shall return the deposit to the Client but shall have no further liability with respect to the Agreement. This limitation on liability shall also apply in the event that photographic materials are damaged in processing, lost through camera malfunction, lost in the mail, or otherwise lost or damaged without fault on the part of the Photographer. In the event the Photographer fails to perform for any other reason, the Photographer shall not be liable for any amount in excess of the retail value of the Client’s order.

Inherent Qualities. Client is aware that Photographer highly recommends using professional labs for printing purchased photos. Using any photo lab outside of what photographer offers cannot guarentee the professional printing quality desired! If client chooses to purchase prints outside of Lisa Gerken Photography, photographer cannot be held responsible for the print quality of any photo.

Photographer’s Standard Price List. The charges in this Agreement are based on the Photographer’s Standard Price List. This price list is adjusted periodically and future orders shall be charged at the prices in effect at the time when the order is placed.

Photographer is obligated to explain: Upon reviewing samples of my work, you have decided to invest in my services because you are confident I can provide you with the best results. There is no knowing what photos will be produced. Photographer cannot guarentee and particular photo or pose.

As an artist I reserve the right to artistically interpret what I choose to photograph. Some shots may be color, some may be black and white. This is the choice of the photographer and not the client. Lisa Gerken Photography makes no guarentee to any subjective opinion made by client or other persons reguarding images. Photographer is always willing to listen to client’s concerns or ideas, but this does not give client permission to badger or verbally abuse the photographer for any choice that is made in which direction to take the photography session or the final outcome of an image. The professional opinion of photographer always has the final say!

Occassionally sneak peeks from the gallery will be shared on Facebook. Client is allowed to tag themselves and anyone else they would like to tag. Photographer asks to wait making any picture a cover page, profile picture, or sharing any image on their page for atleast 24 hours after an image has been posted. This allows more people to comment on the original picture posted and gives photographer an opportunity to invite new people to their fan page. Photographer just asks that you always give credit where credit is due.

*It is not Lisa Gerken Photography’s responsibility for the lifespan of your images! Client must remember to download all images to a safe hard drive, USB, Flash drive, or CD disc.
