In consideration for being permitted to participate in the Easter Egg Hunt to be held on April 16, 2022(“Event”) sponsored by the McCandless Community Association and hosted by the Town of McCandless, and intending to be legally bound hereby, the undersigned, on his or her own behalf, and as applicable, on behalf of his or her minor child, states as follows:

1. I am aware that participating in the above Event or any other activity involves certain inherent risks, dangers and hazards that can result in serious personal injury. I hereby freely agree to assume and accept all known and unknown risks of injury arising out of my participation / my child’s participation in the Event. I acknowledge and agree that I am solely responsible for my child’s care, supervision, guidance and/or control during my child’s participation in the Event.

2. On behalf of my child and in my own right, I hereby remise, release and forever discharge the McCandless Community Association and the Town of McCandless and their respective officers, directors, administrators, Council members, board members, employees and insurers, of and from all, and all manner of, liability, actions and causes of action, suits, debts, covenants, contracts, agreements, judgments, claims and demands whatsoever, arising out of my / my child’s participation in the Event and any related program activity, and any injury, disability or death resulting from such participation.

3. I also agree to defend, indemnify and hold harmless, the McCandless Community Association and the Town of McCandless and their respective officers, directors, administrators, Council members, board members, employees and insurers, from any and all claims, suits, procedures, costs, expenses, damages and liabilities, including attorneys; fees, arising from or related to my / my child’s participation in the Event.

4.I do hereby grant permission to McCandless Community Association and the Town of McCandless, its owners, directors, employees, agents, and volunteers to photograph or videotape the registered player(s) herein. I hereby grant permission to McCandless Community Association and the Town of McCandless to edit, crop, or retouch such photos/video, and waive my rights to inspect the final product. I consent to the use of said photos/videos to be used by McCandless Community Association and the Town of McCandless worldwide for any purpose, including educational and advertisement purposes, and in all media, whether now known or hereafter devised, including print and electronic media. I understand that McCandless Community Association and the Town of McCandless may use such photographs with or without associating any names thereto. I further waive any claim for compensation of any kind for McCandless Community Association and the Town of McCandless to use or publication of said media. I hereby fully and forever discharge and release McCandless Community Association and the Town of McCandless from any claim for damages of any kind (including, but not limited to, invasion of privacy; defamation; false light or misappropriation of name, likeness, or image arising out of the use or publication of media) of the registered player herein by McCandless Community Association and the Town of McCandless and covenant and agree not to sue or otherwise initiate legal proceedings against A McCandless Community Association and the Town of McCandless for such use or publication on my own behalf or behalf of the registered player(s) herein. All grants of permission and consent, and all covenants, agreements, and understandings contained herein are irrevocable. Minimum Age: Parent Or Guardian By accepting, I certify that I am at least 18 years old or that I am the parent or legal guardian of the registrant(s) who is less than 18 years old, and that the information set forth above pertaining is true and complete and that I have signed it voluntarily, intending to be legally bound and understand that my execution of this document is an express requirement for my participation in activities run by McCandless Community Association and the Town of McCandless at any venue. This waiver and release shall remain in effect for all McCandless Community Association and the Town of McCandless activities in which I/my child/my children participate in.

I HAVE READ THIS WAIVER OF LIABILITY, ASSUMPTION OF RISK AND INDEMNITY AGREEMENT AND FULLY UNDERSTAND ITS TERMS. I ACKNOWLEDGE THAT I AM SIGNING THE AGREEMENT FREELY AND VOLUNTARILY, WITH THE INTENT TO BE LEGALLY BOUND AND THAT I INTEND MY SIGNATURE TO BE A COMPLETE AND UNCONDITIONAL RELEASE OF ALL LIABILITY.
