Nature of my Employment. If I work for Jimmy Jones Heating & Air, I agree that I will be an at will employee, which means that either I or Jimmy Jones Heating & Air can end my employment at any time, with or without cause or notice. I agree that no written materials or verbal statements made by Jimmy Jones Heating & Air will constitute an express or implied contract of employment, and that this relationship could only be modified in writing identifying me by name and signed by the President of Jimmy Jones Heating and Air.
My Participation in Jimmy Jones Heating and Air’s Drug Free Environment. I am not a current user of illegal drugs, and I agree to abide by Jimmy Jones Heating & Air’s Drug and Alcohol policy, and I will not work under the influence of drugs or alcohol.
My Records and References. There is nothing in my background that would cause a risk to Jimmy Jones Heating and Air’s customers, employees, or property. I authorize Jimmy Jones Heating & Air to conduct reference checks, criminal and driving records checks, and other consumer report investigations. I release all parties from any liability for providing such information to Jimmy Jones Heating & Air.
The information I have given on this application is true and complete. I agree to promptly notify Jimmy Jones Heating & Air if I am later charged with or convicted of a felony, misdemeanor, or a driving offense. I agree that any false information or omission allows Jimmy Jones Heating & Air to refuse to hire me, or to terminate my employment. I agree that a photocopy or imaged copy of this signed agreement will be as valid and enforceable as the original.
I certify that I am applying for this position because I wish to work for and contribute to the success of Jimmy Jones Heating & Air, and for no other reason. I understand that if I am employed by Jimmy Jones Heating & Air, I will have a fiduciary duty to Jimmy Jones Heating & Air to act in its interests, and not in the interests of any other employer. I understand that I am obligated to follow all safety policies of Jimmy Jones Heating & Air. I also understand that I must treat confidentially any information I learn in the course of my employment.
ARBITRATION OF EMPLOYEE RIGHTS
Because of the delay and expense of the court systems, Jimmy Jones Heating & Air and I agree to use confidential binding arbitration, instead of going to court, for any claims that arise between me and Jimmy Jones Heating & Air, and/or their current or future employees. This concerns claims concerning compensation, employment, sexual or other types of harassment, or termination of employment. Before arbitration, I agree first to present any claims in writing and in full detail to Jimmy Jones Heating & Air and next to complete any Jimmy Jones Heating & Air’s internal review process. Nothing in this agreement to arbitrate shall prevent me from filing a claim with any external administration or agency (such as the EEOC or similar state or local agency). In any arbitration, the then-prevailing rules of the American Arbitration Association (and, to the extent not inconsistent, the Federal Arbitration Act) shall apply.
NOTICE BEFORE ORDERING CONSUMER REPORTS (Including Motor Vehicle Reports and Credit Reports)
The Fair Credit Reporting Act (FCRA) provides individuals with certain rights regarding consumer reports and places certain obligations on employers using consumer reports for employment-related purposes. Consistent with FCRA’s requirements, this notice is provided to you in order to inform you that Jimmy Jones Heating and Air may, for employment-related purposes, obtain from a consumer reporting agency one or more consumer records.
AUTHORIZATION TO OBTAIN CONSUMER REPORTS
I hereby acknowledge that I have read and understand the contents of the above notice and authorize Jimmy Jones Heating & Air to obtain one or more consumer reports on me for employment-related purposes.
