Model/Talent Agency Terms & Conditions:
I agree to engage the services of "Fleur Chantilly Enterprises" (herein referred to as the "Agency") to officially represent my persona and name in the areas of entertainment, fashion, modeling, and talent in Canada only. This agreement governs my representation in these industries and does not affect other employment opportunities, contracts with other agents, record producers, scouts, or any other sources of income. The Agency will actively seek contracts and opportunities to provide me (herein referred to as "Talent") with paid work and related career opportunities.
The Agency is authorized to distribute my name and image to current and prospective clients or leads, as well as on their social networks, website, and talent books for promotional purposes. This distribution includes print, image, music usage for promotional purposes, and radio and TV opportunities. If direct application or personal interview is required by the client, I agree to attend and apply as outlined by the Agency. The Agency will assist in preparation and costs for attending these events or meetings.
If I am directly contracted or employed through the Agency's lead, I will inform the Agency, and their commission remains payable. I have the right to decline job offers without penalty. I will inform the Agency of all outside work booked and appearances made on a monthly basis. The Agency's commission does not apply to these outside bookings unless the Agency assists in collecting payment.
The Agency's commission of 20% applies to any position referred by the Agency. If payment is made directly to me, I will remit the Agency's commission within 24 hours of receipt. When payment is made to the Agency, commission fees will be deducted before remittance. If I am in arrears on commission payments, they must be paid in full from the next scheduled booking, or the Agency may discontinue further bookings until fees are paid. A $50 fee applies for any returned checks.
I will notify the Agency at least 72 hours in advance of any performance cancellations due to unforeseen circumstances, such as natural causes or serious illness/injury (with medical note). Less than 72 hours' notice may result in a penalty unless the Agency finds an acceptable replacement or reschedules the booking.
The Agency and its clients are not liable for any harm, injury, loss, or damage to me or my property, unless due to direct negligence or unlawful conduct by the client. The Agency will assist with billing and collections if clients fail to pay, but is not liable for unpaid monies. The Agency may charge a deposit to ensure performance, refundable if the client does not pay for the performance.
I agree to refer any direct solicitations for future work received during Agency bookings to the Agency. Failure to comply may result in disqualification from work and penalties. I will maintain confidentiality of all information related to the Agency's business, clients, and other models/talents. Breach of confidentiality or defamation may result in penalties and legal action.
I understand that this agreement is not an employment contract and does not make me an employee of Fleur Chantilly Enterprises. The Agency will provide mentoring, marketing, a publicist, agent, billings, connections for models and other talents, dressing rooms, sponsored clothing and jewelry, beverage tabs, accounting, publications, a talent photoshoot, and a press kit.
I may terminate this contract with 30 days' written notice to the Agency. The agreement renews annually and remains in effect for one year from the acceptance date. By entering my information below, I agree to abide by the terms and be legally bound by them.
